Each criminal charge involves a unique set of facts and circumstances. In some cases, the evidence will be weak, or may even be inadmissible if it was obtained in violation of a person’s constitutional rights. In these cases, prosecutors may have a legal obligation to dismiss a case if sufficient admissible evidence does not exist to support a conviction.
In other cases, the prosecution may recognize weaknesses in their case, and may propose a plea bargain in lieu of trial. In these circumstances, we consult with our client to explain such offers and the advantages and disadvantages of accepting the same, so that they can make the decision that is best for them about whether to proceed to trial. At all times we take our direction from our clients in terms of how they wish to proceed on a case.
